Terms & Conditions
GENERAL: if you have any questions of how any of the below conditions may affect the services we provide I your specific case, we will happily explain to you.
- Peace of Mind (POM) provides consultancy and mediation services to the best of its abilities. POM doesn’t provide any guarantees related to its services and/or its results and outcome.
- POM’s liability will never exceed the amount POM invoices and has been paid for any service it provides or has provided. POM may ask and shall be given an indemnity by the client if circumstances so demand.
- Except when and to the extent laid down in these conditions and any written or email correspondence, the general South African legislation applicable to POM’s activities and suggested solutions shall apply.
- All POM’s services are subject to confidentiality, except to the extent POM may need to divulge information to pursue any matter it’s being asked to give advice on. This will be agreed well in time. Client acknowledges that all (private) information relevant to POM’s services will be made available upon first request.
- POM’s services will be paid immediately at the end of each consultancy session (or differently, if so agreed) immediately upon receipt of the invoice. Subsequent and follow-up services may be put on hold by POM until proof of payment has been received for any work done.
- The first 15/30 minutes session is free of charge, provided the booking has been made and the requested information form has been received by POM prior to this intake session. At the end of the first session B&B will propose if and how to proceed, including a quotation, which must be approved by the client in writing, before POM will proceed.
- A client may stop working with POM any time he/she so chooses, provided all outstanding invoiced costs have been paid.
- If an hourly rate is applicable for POM’s services, this is ZAR 1100.- for businesses and ZAR 800.- for individuals. If we can, we will propose a fixed fee. Straightforward wills can, after mutual consent, be done free of charge, provided POM will be appointed as executor for a fee of 2,75% of the estate’s net value, or as otherwise agreed.
- POM works in association with a number of attorneys in Stellenbosch and Cape Town and may propose to take cases to them if and when POM cannot serve the client further, especially when court or regulated representation is a necessity. This needs prior client approval.
- POM will communicate regularly progress to the client, in a concise manner. Client will, if need be, sign a mandate form to be provided by POM, for it to act on behalf of the client.
- Clients will keep POM updated on any (new) information which may have a bearing on our services, including, but not limited to any other professional advice they obtain for the matter under advice.
- These conditions have been created for POM to provide an accessible, focused, yet relatively low-cost service and POM may halt their services when these conditions are not upheld. The client will be liable to pay any agreed cost when the consultancy services are thus terminated.
